These terms ensure the reliable delivery of our high-quality Internet, Ethernet, and colocation services across our global network.
Service Scope
Overtaking provides advanced Internet, Ethernet, and colocation solutions via a facilities-based, all-optical IP network. These services are available across 260 markets in 56 countries, supporting over 126,333 Enterprise and NetCentric connections. The services are designed to meet enterprise-grade reliability and performance standards.
Service Availability
Our commitment is to deliver uninterrupted and high-speed connectivity. However, service availability may be subject to factors beyond our control, such as natural disasters, third-party disruptions, or maintenance activities. We will make every effort to notify you in advance of any planned interruptions.
Customer Responsibilities
- Fair Usage: Customers must adhere to Overtaking’s fair usage policies and ensure that network resources are used responsibly and without harm to others.
- Compliance: Customers must comply with applicable laws and regulations while using our services. Unauthorized activities, including spamming, hacking, or distributing illegal content, are strictly prohibited.
- Accurate Information: Customers are responsible for providing accurate and up-to-date information for account setup and ongoing service delivery.
Billing and Payment
- Services are billed in accordance with the agreed terms outlined in the customer’s service agreement.
- Payments are due on the specified dates, and failure to pay may result in service suspension or termination.
- Additional charges may apply for overages, custom configurations, or support beyond the scope of standard service agreements.
Service Level Agreement (SLA)
Overtaking guarantees high availability and low-latency performance across our network. Detailed SLA metrics, including uptime guarantees and response times, are included in individual customer agreements. Compensation for SLA violations, if applicable, will be handled in accordance with the terms specified in your agreement.
Privacy and Security
We prioritize the security and privacy of your data. Overtaking implements industry-leading security measures to protect customer information and maintain compliance with global data protection standards.
Termination of Services
Both parties may terminate services with prior written notice as outlined in the customer agreement. Breaches of these Service Terms may result in immediate suspension or termination of services.

Overtaking reserves the right to update these Service Terms as needed. Any changes will be communicated to customers in a timely manner.
